Terms of Service

1. Acceptance of Terms

By accessing or using any service operated under the NevetsInc brand ("Service"), you agree to be bound by these Terms and our Privacy Policy to the extent an enforceable agreement can be formed under applicable law. If you do not agree to all terms and conditions, you must not access or use our services.

2. Age Eligibility & Parental Consent

Spark and NevetsInc services are designed for users aged 13 and older. You represent and warrant that:

• You are at least 13 years of age.
• If you are under 16 years of age, you have obtained the verifiable consent of a parent or legal guardian (in accordance with digital-consent standards under GDPR Article 8, applied globally across our services).
• All registration and verification information you submit is accurate, truthful, and belongs to you.
• If you are a parent or guardian permitting a minor to use the Service, you accept full responsibility for their compliance with these Terms.

Accounts found to be operated by individuals under 13, or under 16 without requisite parental consent, will be terminated immediately upon discovery.

3. Prohibited Content & Strict Minor Protection

Because minors use our platform, we enforce a strict, zero-tolerance policy against harmful, dangerous, and inappropriate content:

• Zero Sexual Content for Minors: Any sexual content, sexual solicitation, exploitation, grooming, or sharing of intimate imagery involving or directed at minors is strictly prohibited and results in immediate permanent bans and mandatory reporting to law enforcement authorities (including NCMEC and EU authorities).
• No Harassment or Hate Speech: Bullying, stalking, intimidation, defamation, discrimination, and hate speech are strictly banned.
• No Commercial Solicitation or Scams: Using the platform for commercial solicitation, financial scams, prostitution, escorting, spam, or requesting money from other users is prohibited.
• No Impersonation or Fraud: Misrepresenting your age, identity, qualifications, or intent is a violation of these Terms.

4. User Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify NevetsInc support immediately of any unauthorized access. One person may maintain only one active account.

5. Identity Verification

Spark offers identity verification checks (selfie/photo verification) to maintain a safe, authentic community. Verification documents are stored in dedicated, access-restricted encrypted storage accessible only to our moderation team and the user, never displayed publicly, and handled in strict accordance with our Privacy Policy.

6. Content Ownership & Limited License

You retain ownership of the original text, media, photos, and voice notes you upload to our services. You grant the operators of the Service a non-exclusive, worldwide, royalty-free license to store, process, and display your content solely as necessary to operate the Service (such as delivering your chat messages, rendering your profile to matched friends, and publishing your 24-hour statuses).

7. Message Actions & Retention

To protect conversation integrity while allowing error correction, Spark allows message editing and soft-deletion within a 1-hour window. Deleted messages are marked with a soft-deletion indicator and are no longer readable by conversation participants.

8. Intellectual Property

Software, algorithms, designs, logos (Spark, NevOS, NevAI, NevetsInc), interfaces, audio assets, and documentation are associated with the NevetsInc project and its relevant rights holders, including founders Birloi Eduard Ștefan & Patrinoiu Calin, and may be protected by applicable copyright, trademark, and intellectual property laws.

9. Disclaimers & Limitation of Liability

Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. To the maximum extent permitted by applicable Romanian and EU law, the operators of the Service shall not be liable for indirect, incidental, or consequential damages arising from the use of our services.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of Romania, without regard to conflict of law principles. EU consumers retain all mandatory statutory consumer protection rights.
